Privacy Policy

1    INTRODUCTION
    This document sets out the privacy policy of Huddl. Pty Ltd (ACN 674 302 446) (referred to in this privacy policy as ‘we’, ‘us’, or ‘our’).
    We take our privacy obligations seriously and we’ve created this privacy policy to explain how we store, maintain, use and disclose personal information.
    By providing personal information to us, you consent to our storage, maintenance, use and disclosing of such personal information in accordance with this privacy policy.
    We handle personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).
    When the platform is used in schools, we act as a service provider to the school and process student information on the school’s instructions and authorisations (including parent/guardian consent as required under state/territory education policies). 
    Where a state or territory imposes additional requirements (e.g. state privacy/health records laws), we support schools to meet those obligations and will enter into reasonable data-handling terms if required. 
    We minimise collection, use information only for the educational purposes described in this Policy, do not sell personal information, or disclose it only as set out here or with the school’s instruction or consent.
    We may change this privacy policy from time to time by posting an updated copy on our website or Platform, and we encourage you to check our website and Platform regularly to ensure that you are aware of our most current privacy policy.
2    TYPES OF PERSONAL INFORMATION WE COLLECT
    Huddl collects both personal information and non-personal data to deliver our services, support your teaching needs, and improve the platform. The specific data collected depends on your role, your use of the platform, and the features you engage with.
2.2    FOR TEACHERS AND SCHOOL STAFF
    When you register for a Huddl account or use the platform, we may collect the following personal information:
(a)    full name and preferred title;
(b)    department email address;
(c)    date of birth;
(d)    sex/gender;
(e)    school or organisation name;
(f)    role (e.g. HPE teacher, coordinator, HOLA);
(g)    subjects taught and year levels taught;
(h)    class titles and group names;
(i)    contact preferences;
(j)    login credentials (e.g. email and OTP-based access)
(k)    your device identity and type, I.P. address, operating system and screen size, geo-location information, usage logs and interaction patterns, crash reports or error logs, advertising data and standard web log information; and
(l)    any other information provided by you to us via our platform, or otherwise required by us or provided by you.
    If you subscribe to a paid service, we may also collect payment-related information through our third party payment processors (e.g., via Stripe), though Huddl does not directly store full credit card numbers. Stripe’s services are governed by their own Privacy Policy.
2.3    FOR STUDENTS
    The personal information we collect about students may include the following:
(a)    student full name;
(b)    sex/gender;
(c)    year level and class group;
(d)    faction (house/team);
(e)    classroom teacher’s name;
(f)    optional parent/guardian email (if entered by the teacher);
(g)    assessment results, insights, and analytics;
(h)    progress reports and feedback generated within the platform;
(i)    if input by a teacher, functional movement characteristics and diagnosed learning or physical conditions;
We collect only the information necessary to operate the platform, provide you with functionality of the platform and provide educational services. Teachers must ensure they have appropriate consent before entering sensitive data.
Huddl does not intentionally collect biometric data, political views, religious beliefs, or sexual orientation. Any such information should not be submitted into the platform. Health-related data is limited to what teachers voluntarily enter to better support their students' physical education experience.
We do not collect or store:
(j)    photos or videos of students;
(k)    biometrics; or
(l)    location tracking of students.
3    PERSONAL INFORMATION OF MINORS
    Prior to using the platform, schools, including its employees, contractors and agents, are solely responsible for:
(a)    obtaining parent and/or guardian authority and consent to our storage, maintenance, use and disclosure of student personal information; and
(b)    agreeing to Platform Terms and Conditions.
By using our application, you confirm that you and/or the school have obtained such authority or consent as required under the Privacy Act 1988 (Cth) and relevant State or Territory education laws.
Parents or guardians may contact us through the details set out in paragraph 12 to review, manage, or request deletion of their child’s personal information.
We acknowledge that each state or territory Department of Education may require schools to complete a third-party service risk assessment before using the platform with students. To support this, we provide a data inventory, security posture, data hosting location, retention and deletion practices, and details of any third-party processors (such as Stripe) so schools can complete their assessments.
4    HOW WE COLLECT PERSONAL INFORMATION
    We may collect personal information through a combination of direct user input and passive system interactions, including where: 
(a)    the school provides us with personal information of teachers or students;
(b)    teachers or other users input personal information into the platform, including personal information of students;
(c)    when we are contacted through our website or platform; and
(d)    interact with our website, social applications, services, content and advertising.
    We may also collect personal information when you use or access our platform, website or our social media pages. This may be done through use of web analytics tools, ‘cookies’ or other similar tracking technologies that allow us to track and analyse your website usage. Cookies are small files that store information on your computer, mobile phone or other device and enable and allow the creator of the cookie to identify when you visit different websites. If you do not wish information to be stored as a cookie, you can disable cookies in your web browser.
5    USE OF YOUR PERSONAL INFORMATION
5.1    STUDENT PERSONAL INFORMATION
    We collect and use student personal information for the following purposes:
(a)    for providing educational-related features to teachers, including generating performance insights and analytics for teachers and students;
(b)    to support educational planning, tracking, reporting and record keeping;
(c)    to enable AI-assisted features, in line with the Australian Framework for Generative AI in Schools; and
(d)    to comply with our legal obligations.
    We will not use student personal information for marketing or any purpose unrelated to education, unless otherwise required by law or court.
5.2    NON-STUDENT PERSONAL INFORMATION
    We collect and use non-student personal information for the following purposes:
(a)    to create and manage school/teacher’s Huddl accounts;
(b)    to provide goods, services or information to teachers and schools, including enabling access to the platform’s features;
(c)    to comply with our legal obligations, resolve disputes or enforce our agreements with third parties;
(d)    to send users marketing and promotional messages and other information that may be of interest to you and for the purpose of direct marketing (in accordance with the Spam Act). In this regard, we may use email, SMS, social media or mail to send you direct marketing communications. You can opt out of receiving marketing materials from us by using the opt-out facility provided (e.g. an unsubscribe link);
(e)    to send users administrative messages, reminders, notices, updates, security alerts, and other information requested by you.
5.3    COOKIES
    We do not use cookies for advertising or third-party tracking. Any cookies or local storage are used strictly for login persistence, session management, or to improve load times. We do not use Google Analytics or any similar third-party analytics tools that transfer data outside Australia. Any usage metrics we collect are fully anonymised and stored within our Australian infrastructure.
5.4    PLATFORM IMPROVEMENTS
    Huddl may collect and analyse de-identified assessment data (e.g., skill component averages, proficiency rates, and usage statistics) to improve the accuracy, fairness, and educational relevance of our AI models and assessment algorithms.
    All information used for analytics or research is aggregated and anonymised, ensuring that no teacher, student, or school can be identified from the data. For example, Huddl may share anonymised statewide or national statistics publicly, such as: “Across 12,000 student assessments, the average horizontal jump take-off angle improved from 34° to 41° between Years 3–5.”
    Aggregated trends (such as state-wide or national averages in movement skill proficiency) may be shared with the education community to support research and curriculum development. Huddl will never disclose or publish identifiable student or school data without explicit consent.
6    AI TRANSPARENCY AND TEACHER OVERSIGHT
Some features of the platform may analyse movement data from videos to generate assessment insights aligned with curriculum standards.  AI judgments are based on measurable movement metrics (e.g. joint angles, timing, sequencing) compared to developmental benchmarks.  Teachers can view which skill components were met vs. missed, with plain-language feedback.  Teachers may request corrections (e.g. override grades) if they believe the AI assessment is inaccurate.
We may use automated systems to make decisions that significantly affect students, such as recommending assessment results. These processes involve the use of personal information to evaluate certain aspects about students such as their physical education skills. Teachers and school staff are solely responsible for overseeing, reviewing and exercising their professional judgement on such results and making their own determination as to student performance.  Students should direct any request for human review of any automated decision from their teacher or relevant school staff.
    Student identifiable data is never used in training generative models and data is anonymised and stripped of identifiers.  We may use de-identified assessment data to train our AI features. All AI training and analytics processes follow secure protocols and do not involve the use of student images or video content unless explicitly permitted and anonymised.
    Huddl commits to alignment with the Australian Framework for Generative AI in Schools and WA DoE AI principles, updating practices as frameworks evolve.
7    STORAGE, DISCLOSURE AND PROTECTION OF PERSONAL INFORMATION
    All personal information we collect is stored on secure Australian-based servers.  Data is encrypted using industry-standard encryption methods at rest and in transit.  No personal information is transferred overseas.
    Only authorised Huddl personnel and approved service providers have access to sensitive data, and only for the purpose of operating or supporting the platform.
    if an overseas disclosure is ever necessary, we will notify the school in advance and apply appropriate safeguards. If a data incident occurs that is likely to cause serious harm, we will notify the affected school and comply with any applicable notifiable data breaches scheme.
    We do not publish student data. Any publication of student work, images, or information outside the platform remains the responsibility of the school/teacher and must follow local Department of Education consent and clearance procedures.
    Our employees and contractors are bound by confidentiality agreements, and breaches of such agreements may lead to suspension or termination of access.
    We retain personal and student-related information only for as long as it is necessary to provide our services, comply with legal obligations, or support educational value.
8    SECURITY
    We take reasonable steps to ensure your personal information is secure and protected from misuse or unauthorised access. Our information technology systems are password protected, and we use a range of administrative and technical measures to protect these systems. However, we cannot guarantee the security of your personal information.
    We monitor our systems for unusual activity and maintain an incident response plan in the event of a breach or compromise.  If a data breach occurs in relation to personal information that is likely to result in serious harm to an individual, we will notify affected individuals and the relevant authorities in accordance with applicable laws.
9    LINKS
    Our website may contain links to other websites. Those links are provided for convenience and may not remain current or be maintained. We are not responsible for the privacy practices of those linked websites and we suggest you review the privacy policies of those websites before using them.
10    REQUESTING ACCESS OR CORRECTING YOUR PERSONAL INFORMATION
    If you wish to request access to the personal information we hold about you, or if a student, parent, guardian or carer wishes to request access to personal information we hold about the student, please contact us using the contact details set out below including your name and contact details. 
    We may need to verify the identity of the person requesting such details before providing such information. In some cases, we may be unable to provide you with access to all your personal information and where this occurs, we will explain why. We will deal with all requests for access to personal information within a reasonable timeframe.
    If you think that any personal information we hold about you is inaccurate, please contact us using the contact details set out below and we will take reasonable steps to ensure that it is corrected.

    If you wish to complain about how we handle your personal information or believe your privacy has been seriously invaded, please contact us using the details provided below with your name and contact details.
